{"id":1880,"date":"2010-11-12T16:42:57","date_gmt":"2010-11-12T21:42:57","guid":{"rendered":"http:\/\/orbittrap.ca\/?p=1880"},"modified":"2010-11-12T16:58:56","modified_gmt":"2010-11-12T21:58:56","slug":"is-it-too-late","status":"publish","type":"post","link":"http:\/\/orbittrap.ca\/?p=1880","title":{"rendered":"Is it <i>too late<\/i> to patent your fractals?"},"content":{"rendered":"<p>In a previous post, <a href=\"http:\/\/orbittrap.ca\/?p=1867\">Can you <em>really<\/em> copyright an Ultra Fractal parameter file?<\/a>, I questioned the validity of copyright protection for parameter files.\u00a0 I based this on my observation that what parameter files do is categorically different from what\u00a0 image files do and more in keeping with the types of things the US Copyright Office excludes from copyright protection.<\/p>\n<p>Some of those kinds of things that are excluded like procedures, processes, and methods      of operation, are handled by patent law and not copyright law.\u00a0 The different legal context arises from the differing nature of those two types of things:\u00a0 for instance, you don&#8217;t copyright a procedure, you patent it.<\/p>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-1882\" title=\"patent01\" src=\"https:\/\/i0.wp.com\/orbittrap.ca\/wp-content\/uploads\/2010\/11\/patent01.png?resize=325%2C500\" alt=\"\" width=\"325\" height=\"500\" \/><\/p>\n<p>If Ultra Fractal parameter files fall under patent law and not copyright law then anyone wanting to protect their work will have to get it patented &#8211;copyright won&#8217;t mean a thing because UF parameter files are not &#8220;copyright things&#8221;.\u00a0 But acquiring patent protection is quite a different matter from copyright protection.\u00a0 Copyright protection is automatic and only requires formal (i.e. paid) registration in the event that you actually want to take someone to court for infringement.\u00a0 Patents always require official registration and most importantly<em>:\u00a0 fast registration!<\/em><\/p>\n<p>After <a href=\"http:\/\/www.nolo.com\/dictionary\/one-year-rule-term.html\">a year<\/a> of your parameter file being publicly available, the Patent Office will not allow it to be patented.\u00a0 It is no longer patentable because you&#8217;ve waited too long; your opportunity to protect your work has now officially expired!\u00a0 Copyright is vastly different than this and it simply requires proof that you&#8217;re the author should it ever be questioned <em>at some point down the road<\/em>.\u00a0 Official copyright registration will probably prevent it from ever <em>being<\/em> questioned but it&#8217;s not necessary and copyright protection now lasts for the life of the author plus an additional seventy years &#8211;well over a hundred years in many cases.<\/p>\n<p>But patents only last for <a href=\"http:\/\/en.wikipedia.org\/wiki\/Term_of_patent_in_the_United_States\">20 years<\/a> and in the case of <a href=\"http:\/\/en.wikipedia.org\/wiki\/Design_patent\">design patents<\/a> (ornamental design of a functional item), the duration is a mere 14 years.\u00a0 Interestingly, 14 years was the original length of time for copyright protection when it was first created back in the late 1700&#8217;s around the same time as patents whose initial lifespan was also 14 years.\u00a0 Copyright has been extended to almost ten times its original length while patent protection has remained pretty much the same.<\/p>\n<p>Does it change your perspective on parameter files to view them as &#8220;patentable things&#8221; rather than &#8220;copyrightable things&#8221;?\u00a0 It should because it will cost you between <a href=\"http:\/\/www.uspto.gov\/web\/offices\/ac\/qs\/ope\/fee2009september15.htm#patapp\">$80 to $300<\/a> to patent your parameter file and you&#8217;ve got to do it quickly.\u00a0 But copyright, as almost every fractal artist knows, is free, automatic and 24\/7.<\/p>\n<p><img data-recalc-dims=\"1\" loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-1883\" title=\"patent2\" src=\"https:\/\/i0.wp.com\/orbittrap.ca\/wp-content\/uploads\/2010\/11\/patent2.png?resize=368%2C394\" alt=\"\" width=\"368\" height=\"394\" \/><\/p>\n<p>Internationally, and fractal art is very international, patents are also much different than copyright.\u00a0 Thanks to Mickey Mouse and his Disneyland gang, fractal artists get to stand under a huge umbrella of automatic and near endless copyright protection held up by the ever-strengthening arm of Mickey himself and whole-heartedly agreed upon by almost every nation via global trade treaties.\u00a0 Your copyrights will likely still be in force when your grandchildren are around and you&#8217;re long gone:<em> &#8220;Thanks for leaving us all your fractals, Grandma.\u00a0 What are they?&#8221;<\/em><\/p>\n<p>But the <a href=\"http:\/\/www.mateoaboy.com\/f6\/blog_files\/874912ee2802a38923c533ba23ecf6c5-32.html\">one-year<\/a> window of opportunity for registering a fractal parameter file only applies to a few countries.\u00a0 <a href=\"http:\/\/en.wikipedia.org\/wiki\/Novelty_under_the_European_Patent_Convention#Definition_of_the_state_of_the_art_under_Article_54.282.29_and_.283.29_EPC\">In Europe<\/a> you must patent something <em>before<\/em> making it public, and in some countries, like <a href=\"http:\/\/www.itwire.com\/it-policy-news\/government-tech-policy\/40451-new-zealand-says-no-to-software-patents\">New Zealand<\/a>,\u00a0 software patents don&#8217;t even exist because they don&#8217;t qualify as something that <em>can<\/em> be patented.\u00a0 Just like copyright exclusions, there are patent exclusions too.<\/p>\n<p>So if you want to patent your UF parameter files, the best strategy I can suggest is to at least register them with the Patent Office before posting them anywhere or even showing them to anyone.\u00a0 Then you can officially say &#8220;patent-pending&#8221; when you post them to the UF mailing list.\u00a0 But don&#8217;t say that if they aren&#8217;t being registered because <a href=\"http:\/\/www.allbusiness.com\/legal\/intellectual-property-law-patent\/12317606-1.html\">it&#8217;s an offense<\/a> to label something as &#8220;patented&#8221; or &#8220;patent-pending&#8221; when it actually isn&#8217;t.\u00a0 Patents are a whole different racket than copyright.<\/p>\n<p>So what happens when you don&#8217;t patent your work?\u00a0 It&#8217;s a completely different scenario than copyright:\u00a0 unpatented work automatically becomes <a href=\"http:\/\/en.wikipedia.org\/wiki\/Public_domain\">Public Domain<\/a> &#8212;
